Burnley Council introduced a PSPO (Dog Control) order some years ago to provide Council Officers with powers to tackle dog fouling and require owners to keep control of their dogs on a lead in certain areas.
Fouling of land by dogs
This makes it an offence for any person in charge of a dog, which defecates on any land to fail to immediately remove the faeces. This provision applies to all land which is open to air and to which the public are entitled or permitted to have access within the borough of Burnley.

Dogs on leads
Owners must keep dogs on leads at all times in the following areas:
- All cemeteries, crematoriums, churchyards and burial grounds
- All car parks and public vehicle parking areas maintained by the Council
- All highways, pavements, pedestrianised areas (eg St James’ Street and Charter Walk shopping centre etc)
- Bridleways and rights of way that are not in private ownership
- Bowling greens
- Parts of Towneley Park – Barwise picnic area, the ornamental gardens around Towneley Hall, the Rabbit Walk (crossing the golf course)
- The ornamental area of Scott Park near the pavilions and play area
- The ornamental area of Memorial Park around Knight Hill House and the War Memorial
Keeping of dogs on leads by direction
This Order will enable an authorised Officer to direct an owner to place a dog(s) on a lead where considered necessary in the interests of public safety. The PSPO applies to all land described which is open to air and to which the public are entitled or permitted to have access within the borough of Burnley.
The exclusion of dogs from certain areas
This proposed Order will exclude dogs from the following areas:
- All children’s equipped playgrounds (with or without fencing)
- All ball courts
- All tennis courts
- Thompson Park, Queen’s Park and Towneley Park golf courses (18 & 9 hole and pitch and putt)
Fixed Penalty Notices
The council intends to issue Fixed Penalty Notices to enforce this Public Space Protection Order as prescribed by Section 68 of the Anti-Social Behaviour Crime and Policing Act 2014. The penalty is £100. Failure to pay the Fixed Penalty Notices will result in prosecution with a maximum fine of £1000.
