Mobile Home Sites
The council may licence sites that have gained or are in the process of obtaining the required planning permission to operate as a recognised caravan, mobile home or park home site. These sites are commonly known as ‘protected sites’. They must comply with the Model Standards 2008 for Caravan Sites in England

Mobile Homes Act 2013
The Mobile Homes Act 2013 was introduced to provide greater protection to occupiers of residential caravans, and park homes and came into force on the 1st April 2014. It amends provisions in the Caravan Sites and Control of Development Act 1990 and the Caravan Act 1983.
Amendments made by The Mobile Homes Act 2013 give local authorities provision for charging for enforcement including serving enforcement notices and to carrying out works in default to remedy breaches of site licence conditions. Section 10A of the Caravan Sites and Control of Development Act 1960 requires the local authority to prepare and publish a fee policy, where they propose to charge for functions associated with the legislation. This policy details the level of fees Burnley Borough Council will charge in relation to the different functions covered by the legislation.
The Mobile Homes Fit and Proper Person Test
The Mobile Homes (Requirements for Manager of Site to be Fit and Proper) (England) Regulations 2020 came into force on 1 July 2021.
The purpose of the fit and proper person test is to improve the standards of mobile home site management.
Residential site owners must apply to the Council between 1 July and 1 October 2021, for the relevant person (themselves and/or their appointed manager(s)) to be included in the Council’s public register of fit and proper persons to manage a site.
The application fee is £290 regardless of the number of residential park homes on the site and is non-refundable
Once an application is approved, the registration will normally last for 5 years
What does this mean for site owners?
From 1 October 2021, unless the site is exempt, the site owner must:
• Be a fit and proper person to lawfully operate a park home site, or
• Have a fit and proper site manager in place
Exempt sites
A site is exempt if it’s “a non-commercial family occupied site”. This is:
- Only occupied by members of the same family, and
- Not being run on a commercial basis
