Reminders, final notices and summons

Business rates - reminder

If you do not make your payments on or before your instalment date you may be sent a reminder notice. This reminder will give you 7 days to bring your payments up to date.  If you do not bring your payments up to date within 7 days then the Council can demand full payment of all the Business Rates remaining for the year.

If you fail to comply with the requirements of the reminder notice then the Council will issue a Magistrates' Court summons and costs will be incurred.  If you do make the required payments but later default in your payments you will be issued with a Final Notice.

Business rates - final notice

You will have been sent a Final Notice because our records indicate that you have failed, for a second time this financial year, to pay your monthly instalment on time. You will have already been sent a 'reminder notice' earlier in the year.

Your right to pay by instalments has now been withdrawn and the total sum of remaining Business Rates is now due and payable within 7 days.

If you fail comply with the requirements of the Final Notice a Magistrates' Court summons will be issued and costs of £105.00 will be incurred.

If you respond to the Final Notice by just paying the equivalent of one monthly instalment, a court summons will still be issued for the remaining balance.

Magistrates' Court Summons (NNDR)

If you do not pay as instructed by a Reminder Notice or Final Notice then a Court summons will be issued.

The Council makes complaint to the Magistrates' Court that you (or the Company) have not paid as demanded and the summons will give you notice to appear at the Magistrates' Court at a specified time and date. Costs of £105.00 are incurred on the day the summons is issued and now form part of the debt.

On the date of the hearing the Council will seek to obtain a Liability Order, which will allow us to take further steps to recover the debt if necessary. If the debt is paid in full, including Court costs, prior to the Court hearing then the matter will proceed no further. If the Council obtains a Liability Order then additional costs of £20.00 will be added to the debt.
